Motorist indicted in crash which left defendant, 2 others badly hurt
Laconia:

Staff reports
Monday, November 30, 2009

A Belknap County grand jury has indicted a Wolfeboro man for one charge of aggravated driving under the influence after a two-car accident seriously injured two Laconia High School graduates.

Robert D. Goerss, 25, of 213 North Main St. in Wolfeboro will also face two charges of second degree assault.

An indictment is not a finding of guilt but rather an indication that an independent jury has voted, after hearing from police, that there is sufficient evidence to warrant a superior court trial.

Police allege Goerss was headed toward Meredith on Parade Road amount 2:12 a.m. on Aug. 23 when he allegedly crossed the road and hit an oncoming car being driven by Tyler Smith of Lakeport. Smith suffered a severed aorta and spent a considerable amount of time in Dartmouth-Hitchcock Medical Center in Lebanon.

Smith's passenger, Jeremiah Beam, now of Sherman, Texas, broke his jaw.

Goerss also suffered serious injuries including a broken pelvis.

No date has been scheduled for the trial.
